Driver charged with causing death of judge on Aston Expressway
A driver from Walsall[1] has been charged with causing the death of a judge in an accident on a main route into Birmingham[2]. District Judge Matthew Mawdsley was hit by ‘several cars’ on the A38 Aston Expressway[3], near the junction with Bagot Street.
The 54-year old died at the scene following the incident. Elliott Nash from Willenhall in Walsall has now been charged with causing the judge’s death by driving while uninsured.
He has also been charged with driving while under the influence of cannabis, driving without insurance and failing to stop at the scene. Nash has appeared at Birmingham Magistrates Court where he pleaded guilty to driving without insurance and failing to stop. He will now appear in court to face the further charges.
Peter Burt, acting Deputy Chief Crown Prosecutor at the Crown Prosecution Service (CPS), said: “The CPS has authorised West Midlands Police[5] to charge Elliott Nash, 33, with causing death by driving while uninsured as well as driving a motor vehicle with a proportion of a specified controlled drug (cannabis) above the specified limit.
“The charges are in relation to the death of District Judge Matthew Mawdsley who was struck by several cars on the Aston Expressway, in Birmingham, on 16 December 2022.
“The charges were authorised by the CPS West Midlands Crown Court Unit following a review of evidence received from West Midlands Police.”
Mr Burt continued: “Mr Nash was also charged with driving without valid insurance and failing to stop after a road accident and has already pleaded guilty to those offences when he appeared at Birmingham Magistrates’ Court on Thursday (July 13).
“The Crown Prosecution Service reminds all concerned that criminal proceedings against the defendant are active and that he has a right to a fair trial. It is extremely important there should be no reporting, commentary or sharing of information online which could in any way prejudice these proceedings.”
