Devon magistrates: 18 people in court over Christmas

A woman banned from owning animals for five years and a man jailed for assaulting police are among the cases heard at court over the Christmas[1] period. One man was fined for abusing hospital staff on Christmas Day. All criminal cases start at the magistrates.

The most serious are sent to crown court. Most defendants are dealt with by fines or community orders. Magistrates have the power to send people to prison for up to 12 months.

Here are the most recent defendants to appear at magistrates courts in Exeter, Newton Abbot[2] and Barnstaple[3]. DECEMBER 19 Matthew Worby, c/o Freedom Centre, Branstaple.

Age: 38. On 13/01/2023 at Bideford[4] drove when alcohol above the limit and assaulted a police officer by beating. On 25/09/2023 theft of charity box from Fat Face.

Plea: Guilty. Custody for 12 weeks suspended for 18 months. Disqualified for 20 months.

Adam Peach, Chambercombe Road, Ilfracombe[5]. Age: 39. On 25/01/2023 at Ilfracombe stole spirits valued at GBP805 from Tesco[6].

Plea: Guilty. Community order for six months. Compensation GBP805.

Fined GBP60. Justin Jennings, Halsinger, Braunton. Age: 35.

On 26/11/2023 at Barnstaple[7], Goodleigh Road, driving whilst disqualified and when alcohol above the limit. Plea: Guilty. Community order for 12 months.

Abstain from alcohol for 120 days. DECEMBER 20 Maris Cenusa, Alphington Street, Exeter[8].

Age: 39. On 05/10/2023 at Exeter breached a stalking order. Plea: Guilty.

Defendant has died and the case was discontinued. Troy Coles, NFA. Age: 22.

On 08/11/2023 at Old Tiverton[9] Road, Exeter, stole laundry and foodstuff. Plea: Guilty. Prison 13 weeks.

Compensation GBP180. Jordan Hewitt, Thorverton, Exeter. Age: 31.

On 12/11/2023 at Exeter on Upton Pyne Hill drove when alcohol above the limit. Plea: Guilty. Disqualified for 40 months.

Fined GBP750. Jack Gouldsbrough, College View, Tiverton. Age: 30.

On 26/11/2023 at Bampton Street, Tiverton, stole food from Greggs. Breached a Criminal Behaviour Order. Plea: Guilty.

Custody for 12 weeks suspended for 12 months. Benjamin Carr, Meadowside Road, Sandford. Age: 50.

On 17/12/2023 at Crediton[10] sent communication conveying a threatening message. Plea: Guilty. Committed to crown court for sentence on 18/01/2024.

Diana Susan Curtis, Berry Cross, Langtree, Torrington. Age: 66. Between 26/05/2022 and 26/07/2022 at Winscott Lawn, Peters Marland, Torrington, being the person responsible for an animal, namely a grey Arab stallion known as Mid Morning Monkey failed to provide professional veterinary treatment in respect of the animal’s eye injury and that suffering was unnecessary.

Plea: Guilty. Plus seven other Animal Welfare Act offences. Plea: Not Guilty.

Verdict: Found Guilty. Committed to prison for 12 weeks suspended for 12 months. Seizure order made for grey Arab stallion; five Arab horses; two dogs plus any other animals in her possession.

Pay costs of GBP10,000. Disqualified from keeping animals for five years. DECEMBER 21

Russell Adrian Bishop, NFA. Age: 44. Failed without reasonable excuse to comply with the supervision requirements imposed following release from a period of imprisonment.

Plea: Admits Breach. On 26/06/2023 at Sidwell Street, Exeter possession of a knife in public place. On 20/12/2023 at Exeter burglary Co-op St Thomas stole alcohol.

Plea: Guilty. Custody for 48 weeks. Compensation of GBP510.

Kevin Clive Hutchings, Pattacott Farm, Maxworthy, Launceston. Age: 53. Between 30/01/2023 and 27/02/2023 at Launceston contravened schedule 3 of the Declaration of an Avian Influenza Prevention Zone, in that geese were not housed.

Did not take such steps as were reasonable in all the circumstances to ensure that the needs of geese were met in that did not protect them from pain, suffering, injury and disease by, for example, allowing them access to broken glass and other objects with sharp edges. Plea: Guilty. Plus four other offences under the Animal Welfare Act 2006.

Committed to prison for 22 weeks suspended for 18 months. Disqualified from keeping geese, sheep and pigs for six years. Fined GBP1,200.

To pay costs of GBP6,123. Harvey Goode, Manor Farm Road, Ashton on Trent, Derby. Age: 19.

On 17/03/2022 at Princess Alexandra Court, Exeter, assaulted two police constables by beating. Plea: Guilty. Committed to prison for 42 days.

DECEMBER 22 Lynda Ann Thyer, NFA, Saltash. Age: 60.

On 02/09/2023 at M5 Cullompton[11] drove a Jaguar X Type when alcohol level above the limit and resisted a constable. On 21/12/2023 at Ottery St Mary drove whilst disqualified. Plea: Guilty.

Custody for 12 weeks. Disqualified for 1,498 days. Kyle Neep, Downs View, Bude.

Age: 35. On 01/10/2023 at Exeter failed to produce a specimen. Breached bail.

Plea: Guilty. Custody for 13 weeks. Disqualified for 957 days.

Paul Teare, Blundells Road, Tiverton. Age: 25. On 13/09/2023 assaulted a police officer.

Plea: Guilty. Custody for 16 weeks suspended for 12 months. Alcohol treatment, rehabilitation activity for 15 days.

Compensation GBP200. David Wilkie, NFA, Exeter. Age: 44.

On 22/11/2023 at Exeter assaulted a female causing actual bodily harm. Plea: Guilty. Remanded on conditional bail until sentence of 02/01/2024.

DECEMBER 26 Dean Hiscott, NFA Bideford. Age: 32.

Between 08/08/2023 and 30/08/2023 at Westward Ho breached a restraining order. Possession of 7gms of cocaine and a quantity of amphetamine. Plea: Guilty.

Adjourned for a pre-sentence report. Remanded on unconditional bail until 26/01/2024. DECEMBER 27

Alfred Kent, Hayward Avenue, Exeter. Age: 25. On 25/12/2023 at RD&E Hospital caused a nuisance on NHS[12] premises and resisted a constable in the execution of his duty.

Plea: Guilty.

Fined GBP160.
