Man drove auto sans nod, so no relief: HC

Bengaluru: The Karnataka high court has declined compensation in a 21-year-old accident case that saw an autorickshaw crash into a tree, killing the man at the wheel. The court pointed out that the accident had occurred solely because of the negligence of the man driving the vehicle, which he had taken away without the owner/driver’s permission in the first place.”In this case, the vehicle was not entrusted to the deceased either by the driver or the owner.The deceased had taken it away on his own and the accident had occurred because of negligence on his part,” Justice Lalitha Kanneganti observed in her order.”By any stretch of imagination, the deceased cannot be termed as a third party and there is no liability to the insurance company as per the policy,” she said.Deva Poojari from Kundapura in Udupi district had succumbed to the injuries he sustained in the accident, which occurred on the night of October 11, 2002 in Indiranagar, Bengaluru. He was driving the autorickshaw, which had been parked near the hotel where he was working, and had rammed into a roadside tree.

His mother Krishna Poojarthi filed a claim petition before the Motor Accident Claims Tribunal at Kundapura, seeking Rs 6 lakh as compensation. However, the plea was rejected on March 12, 2007. She then challenged it and the matter was remanded back to the tribunal.

This time, Rs 2,01,500 compensation was awarded on December 26, 2012. She again challenged the order, seeking Rs 6 lakh.The National Insurance Company Limited also contested the matter, saying the deceased had either stolen the vehicle or had taken it without the permission. The data shows a slight rise in fatal accidents involving HTVs this year compared to last year. The number of accidents involving DTC buses and Cluster buses has decreased, while accidents involving HTVs have increased. The district-wise analysis shows that Outer North and South-East districts reported the highest number of fatal incidents involving HTVs.

Delhi Traffic Police is taking proactive measures to reduce accidents by conducting psychological tests for HTV drivers and educating them about traffic rules and road behavior.[3]
