Westchester DA explains why teen won’t face criminal charges in crash that killed Yonkers Detective Sgt. Gualdino

Dec 05, 2023, 10:42pmUpdated 52m ago By: News 12 Staff Westchester’s district attorney expanded on why a 16-year-old will not face criminal charges in a fatal accident that killed Yonkers Police Detective Sergeant Frank Gualdino.

The teenager was originally charged with criminally negligent homicide in the crash that killed Gualdino last December. He was accused of speeding on Tuckahoe Road when his vehicle crossed the double yellow line and smashed into Gualdino’s car and a Bee-Line bus. Rocah says due to the defendant’s age, under the Raise the Age Law and its legal requirements, the case was transferred to Family Court.

Any records will be sealed and the case will now be handled by the Westchester County attorney.

Rocah says she understands the deep disappointment and frustration of the Gualdino family, his friends and the community.
