Child killer, danger driver and prolific paedophile among those jailed in horrific court cases of 2023
This year Teesside Live has reported on some of the biggest court cases which have rattled the region. Among those listed include child killers, abusers and dangerous paedophiles who are now facing lengthy stints in prison. One of the most notable cases saw child killer David Boyd jailed after escaping justice for decades.
Teesside’s Boyd murdered seven-year-old Nikki Allan in a derelict building in Sunderland in October 1992 but evaded justice for more than 30 years. He was finally brought to justice in May when he was told he must serve a minimum of 29 years behind bars before he is considered for parole. Here are the biggest cases of each month this year:
January
The notorious Dale Carter has spent much of his young life in prison racking up a lengthy rap sheet over the years.
Carter – who became the youngest person in Middlesbrough[1] to receive an ASBO – has racked up more than 120 convictions and continues to pester the courts. In January, the 30-year-old was jailed for causing serious injury by dangerous driving and drug driving.
Carter left an 11-year-old boy with life-changing injuries after offering him a ride on his Monster motorbike[2]. The 30-year-old, who has multiple convictions for dangerous driving, stealing cars and driving whilst disqualified, drove at twice the speed limit before ploughing into another small child out riding his push bike.
He didn’t put a helmet on his pillion schoolboy passenger before the smash and caused serious injuries to both children. The 11-year-old boy suffered “life-changing brain injuries.” The six-year-old, who had been allowed outside his home for the first time unaccompanied, was rushed to hospital for surgery to his head and ear. Teesside Crown Court[3] heard how banned Dale Carter[4] was on his Monster motorcycle on the afternoon of April 6, 2022.
He offered the 11-year-old boy, who was with his cousin at an ice cream van, a ride on the back along Middlesbrough’s Premier Road[5]. But moments later, prosecutor Jenny Haigh told the court, “the boy’s cousin started to run. The motorbike crashed.
The boy watching saw his cousin with a deep cut to his head.” Carter had been doing at least 41mph along the residential street which has a 20mph limit. “He ploughed straight into the back of a six-year-old boy out on his bike” Ms Haigh continued, “the motorbike struck the little boy then it went into a blue Ford Kuga.” The Teessider’s passenger was thrown off the motorbike.
The crash was captured on CCTV and showed Carter’s passenger lying in the road, motionless and bleeding to the head. Carter was jailed for three-years-and-three-months[6]. He was disqualified from driving for six-years-and seven-months.
He must pass an extended driving test before being allowed back on the roads.
February
A violent drug addict who killed a vulnerable man who owed him GBP20 was jailed for 10 years[7] in February. Ray Whincup, 36, was standing trial accused of the murder of Mark Robinson when he admitted manslaughter, half way through proceedings. Whincup, formerly of Station Road in Redcar[8], but now of HMP Durham, was jailed for 10 years.
Mr Robinson, 40, was a long-term drug addict who was frightened of being attacked after suffering a stroke in a previous assault. His mother, Gillian Harrison said: “He became terrified that if he was assaulted again, it would kill him. He said he knew some bad people and wanted to protect me from this.”
Killer Ray Whincup’s police mugshot and victim Mark Robinson, circled
But Whincup severely beat Mr Robinson, in the early hours of July 28, 2020, in Redcar.
Mr Robinson was taken to James Cook University Hospital in Middlesbrough, where he was rushed into surgery to treat bleeding on his brain. Doctors called police due to the extent of his injuries – his jaw broken in two places and his spine fractured, in addition to his head injuries. Mr Robinson never recovered from the attack and died on August 5, 2021.
After the sentencing, Mark Robinson’s mum, Gillian Harrison said: “Regardless of the indictment we all know that had it not been for the medical treatment Mark received on July 28, 2020, he would have died that morning in Station Road having suffered a traumatic brain injury because of a vicious, sustained and unprovoked assault from Raymond Whincup. “I struggle to put into words how this has devastated our family. Mark was so much more than a good, decent man who deserved to live and enjoy his life.
As a family we will never forget him, we will celebrate his life and we will always love him and miss him so very much. “We would like to express our profound gratitude to the team from Cleveland Police who have worked tirelessly to secure this conviction. I would also like to add our thanks to the CPS and to the Prosecution Team – and we would also like to thank our support worker from victim support who has been with us every step of the way.
No matter what sentence Raymond Whincup received, as a family we serve a life sentence without Mark.”
March
This tequila-swigging killer driver was on a Facetime call with his girlfriend before a horror smash which claimed the life of a popular taxi driver[9]. Danger driver James Hobson, of Norton[10], crashed head on with Boro[11] Cars taxi driver Malik Ameer Abbas on March 29, last year, on the A172 at Dixons Bank[12]. The Mercedes driver had previously spent an evening getting drunk at the Highfield Hotel and racked up a GBP116 Peroni and tequila bar bill.
At a sentencing hearing in March, Teesside Crown Court[13] heard at around 11.30pm the defendant was captured in footage ‘staggering’ back to his car. Outlining the case, prosecutor Nick Dry said over a period of six hours he consumed eight to 10 pints of Peroni and around eight shots of tequila.
Mr Hobson was spotted speeding on Marton[14] Road, in Middlesbrough[15], by an unmarked police car and the officer activated his sirens. A police chase took place which saw the defendant reach speeds in excess of 100mph and travel on the wrong side of the road.
Mr Dry said the chase lasted for around two and a half minutes and that officers did not immediately realise Hobson had struck the victim’s vehicle until they arrived at the scene seconds later. CCTV footage revealed that the crash took place as the defendant travelled on the wrong side of the road whilst overtaking another vehicle. He crashed straight into the oncoming victim’s vehicle.
Mr Dry said: “Mr Abbas was driving safely within his own lane and stood no chase of evading the head on impact.” The court heard the victim’s vehicle was forced 50 metres backwards and the collision investigator found evidence of last minute braking by the Mercedes. Police at the scene said there was a mobile in the passenger side footwell of the defendant’s car which was engaged in an ongoing Facetime call with a female – believed to be the defendant’s then partner. Paramedics and fire crews were called to the scene, but despite attempts to revive Mr Abbas he was declared deceased.
A pathologist later confirmed that “catastrophic injuries” suffered in the collision caused his death. In mitigation, Hobson’s barrister, Richard Hermann, said the defendant spends his days ‘wishing he could swap places’ with Mr Abbis and ‘wishes he’d died instead’. The court also heard he now has physical and mental health difficulties after the crash.
Hobson, of Washington Grove, Norton, was handed a seven year four month prison sentence. He was also banned from driving for 11 years and eight months and must pass an extended driving test.
April
This woman abused children and was jailed for 15 years following an extensive police investigation. Cheryl Pickles subjected the children to prolonged physical and emotional abuse over the course of several years, together with her partner, Andrew Hadwin.
The pair were convicted of several counts of child neglect and perverting the course of justice following a seven-week trial which ended in January last year[16]. Hadwin was also charged with three counts of rape in relation to non-recent abuse of another child which happened when she was a little girl. The 39-year-old died in prison[17] on February 2 this year, where he had been remanded ahead of sentencing following his conviction.
Enquiries are currently being carried out to establish the circumstances of his death and a file will be prepared for the coroner in due course, reports The Chronicle[18]. The couple’s offending came to light when one of the children bravely disclosed what had happened to them to a trusted adult.
An extensive investigation was launched by Durham Constabulary in 2018. The investigation, which spanned four years and involved more than 150 witnesses, found that Andrew Hadwin and Cheryl Pickles forced children to eat soap, locked them in cupboards, and forced them into boiling hot showers and baths. The couple would also withdraw their access to food, leaving the children to scavenge for scraps to eat.
On one occasion they were found at 4am walking along to a supermarket four miles away to find something to eat. The pair would also order takeaways and make the children watch them eat while stood in stress positions for long periods of time. After three days of deliberations, the jury, sitting at Teesside Crown Court[19], found Hadwin guilty of three counts of rape, seven counts of neglect, and one count of perverting the course of justice.
Pickles was found guilty of five counts of child cruelty and one of perverting the course of justice. She was found not guilty of sexual activity with a child. The 35-year-old, formerly of Bowburn, in County Durham, was sentenced to 12 years for cruelty[20] and three years for perverting the course of justice, to be served consecutively.
May
Child killer David Boyd was jailed for life in May for murdering seven-year-old Nikki Allan.
Nikki vanished from near her home at Sunderland’s Wear Garth flats on October 7, 1992, and her body was tragically found in the derelict Old Exchange building the following morning. The little girl had been stabbed multiple times and smashed over the head with a brick. Twisted paedophile Boyd, from Stockton[21], was eventually convicted of her murder earlier this year.
Nikki’s mother Sharon Henderson waited more than 30 years for justice until advances in DNA led to the killer’s profile being found on Nikki’s clothes.
Boyd was told he will serve at least 29 years behind bars following a trial at Newcastle Crown Court. The torture of Nikki’s parents Sharon and David was laid bare in court, Chronicle Live reports[22]. The court heard of how three decades of pain and anger had taken a heavy toll on the family.
After a long battle, they finally were given some closure after advances in DNA techniques nailed Boyd as the culprit. Sharon, 57, who could not face going into the courtroom for the sentencing hearing, said in a statement read to the court by prosecutor Richard Wright KC that her little girl’s murder had “destroyed” her family’s lives. She said: “Nikki was a bright and sparky child who was always a mammy’s girl.
She had a beautiful smile and was loved. I cannot put into words how I felt when I heard Nikki was missing and was ultimately found murdered.”
Sharon Henderson from Ryhope, visits the grave of her daughter Nikki Allan
She described the “horror” of a 1993 trial when innocent George Heron was found not guilty after being falsely accused of the heinous crime . Sharon said Northumbria Police[23] said at the time they were not looking for anyone else in connection with Nikki’s murder.
Sharon added: “After the acquittal I was accused of being a bad mother.” She said she felt people were angry with her rather than with the killer and she had to fight for justice. Nikki’s dad, David Allan, said in his victim impact statement he feels “anger and hatred”, adding: “I know I will never be able to forgive the man responsible for her murder.” On May 23, Boyd was sentenced to life in prison.
June
Monster Jay Perren will spend the next 30 years behind bars for his sickening crimes
In June, evil monster Jay Perren was told he will spend the next 30 years in prison after he raped a baby[24].
The depraved Teessider was sentenced at Teesside Crown Court[25] after pleading guilty to 25 offences. His sick crimes were committed over a number of years and were documented in 33,000 images and videos which were stored in 140 folders on an SD card. They include:
-
Five counts of rape, including that of a baby
-
Sexual assault of a child under 13
-
Two counts of causing or inciting child prostitution or pornography
-
Three counts of causing or inciting a child under 13 to engage in sexual activity
-
Sexual assault
-
Sexual activity with a child
-
Causing a person to engage in sexual activity without consent
-
Three counts of making indecent images of a child
-
Six counts of taking indecent images of a child
-
Two counts of breaching a sexual harm prevention order
Teesside Crown Court heard the 34-year-old’s offending came to light when police stormed his Stockton[26] home in November 2020.
Officers recovered a number of devices including a hidden phone which contained category A, B, and C indecent images. A month later, police again searched his home recovering further devices. Summarising the investigation into his hideous catalogue of offences, Recorder Watson said: “On this occasion they found material which can only be described as depraved and deplorable.
It gives rise to the various counts on this indictment.” During the hearing, the defendant – formerly known as Stephen Jardine – heard how his crimes left his victims “broke” with one woman saying she contemplated taking her own life and another saying the defendant had “ripped her soul apart”. In a victim impact statement, one woman said: “I was a child when I was abused by this adult. I was burdened with the pressure of being sexually abused by this predator.
This broke me as a person and ripped my soul apart. He is where my downfall began. I completely isolated myself and hated being around any man and feared they’d do the same.”
The court heard Perren has numerous victims and admitted to one he had a “monster inside his head and had to feed it”. A psychiatric report outlined in court concluded the defendant suffers from paedophilic disorder. Perren’s barrister, Victoria Lamballe, said the defendant has admitted to this, she said: “He recognised as far back as 2017 that he needed help.
He admitted to a sexual attraction to children.” The paedophile, now of Cromwell Road, Nottingham, was jailed for 30 years.
July
In July, nine people were sentenced to a total of over 40 years[27] in prison after bringing Class A drugs into Cleveland. Cleveland Police[28] Organised Crime Unit launched an investigation into the criminal activities of a Hartlepool-based group back in September 2019. The group was orchestrating the supply of large quantities of cocaine into the area from Merseyside.
Around 14 kilograms of high-purity cocaine[29] and around GBP200,000 was seized during the course of the investigation. Eight men and one woman were sentenced to a total of 40 years in prison in July.
- Patrick Bradley, 31, of HMP Durham, is known to hold a leading role in directing and organising the rest of the group. He is already in prison serving a sentence for other offences.
He was given eight years and two months in prison.
- Tyler Scott, 31, of Lunebeck Walk, Thornaby, possessed and used the proceeds of crime, living a cash-rich lifestyle throughout the period of the conspiracy. She was given a two-year community order.
- Martin Oliver, 34, of HMP Holme House, pleaded guilty to possession with intent to supply class A drugs and was given 2 years and 8 months in prison.
- Anthony Gofton, 29, of Sheridan Grove, Hartlepool, also held a senior role in the group and controlled other members. He was sentenced to five years in prison.
- Daniel Brown, aged 29, of Waverley Terrace, Hartlepool, handled over GBP100,000 in criminal proceeds and was sentenced to six years and eight months in prison.
- Matthew Nunn, 29, of Hemlington Road, Stainton, and Thomas Brown, 25, of Wynyard Mews, Hartlepool, and Christopher Graham, 28, were used as couriers to transport the drugs.
Graham was sentenced to six-and-a-half years in prison, Nunn to three years and four months, and Brown to three years and eight months in prison.
- Sean Huggins, 21, of Mill Park Drive, Eastham, in Merseyside, was also part of the ten-strong group and was sentenced to four years and five months in prison.
August
This murderer killed his pal after a drugs row and was handed a life sentence[30]. Dean Williams carried out the brutal attack on “friend” Ian Macneil in their mutual friend’s home in Middlesbrough[31] on Sunday November 28, 2021. Teesside Crown Court[32] heard Williams, of Southfield Road in central Middlesbrough, smashed an empty bottle of Lambrini over Mr Macneil’s head, before hitting him with a walking stick.
Dean Williams
The 50-year-old then took Mr Macneil into the kitchen of the Southfield Road bedsit to clean the blood from him, before the 46-year-old victim left and was seen ‘staggering’ around on CCTV. He was later found by police in a doorway and taken to James Cook University Hospital[33], in Middlesbrough.
He was found to be suffering from brain haemorrhaging, fractured ribs and a punctured lung. The court heard medical staff did all they could but he tragically died days later on December 3. Williams was handed a life sentence with a minimum of 16 years in prison after being convicted by the jury.
September
Marie Metcalfe was jailed for life in September and will spend a minimum of 18 years behind bars for the murder of her older sibling, Laura Metcalfe.[34]
The 41-year-old defendant, who has a history of violence, stabbed her sister in the chest with a knife in Brougham Terrace, Hartlepool[35], following a long-running feud. Laura, 44, managed to stumble home and her son called the emergency services following the attack on Good Friday, April 7. But tragically she died in hospital six days later after a cardiac arrest in the aftermath of the attack starved her brain of oxygen.
Teesside Crown Court[36] heard how there had been ongoing tension between family members and Metcalfe hadn’t spoken to her own mother in years.
Metcalfe had previously made a malicious allegation to police about Laura and accused her and two of her other sisters of assault last year. The defendant, of Brougham Terrace, pleaded guilty to murder on the day her trial was due to start. She had seven previous convictions for 14 offences.
A victim impact statement from both the victim and the defendant’s mother, 70, was read out in court. Since Laura’s death she has taken in her three children. “I wouldn’t change having the children for the world but it has had a massive impact on my life.” She added: “Marie has left her niece and nephews without a mam. [The youngest child] cries for his mum day and night.” Judge Howard Crowson sentenced Metcalfe to life imprisonment and told her she would serve at least 18 years behind bars before being eligible for parole.
October
Andrea Cardinale was suffering from undiagnosed paranoid schizophrenia, when he bludgeoned his two friends to death.
Cardinale, who is from Sicily, planned to set fire to the bodies of Antonino “Nino” Calabro, 26, and his fiance Francesca Di Dio, 20, after he killed them on the morning of Wednesday, December 21, 2022. But despite buying a lighter, and dousing the house with fuel, there never was a fire. Hours later, the 22-year-old’s father saw what his son had done and called the Italian emergency services. Teesside Crown Court[37] heard that Cardinale had become obsessed with Satanism and spells, and he believed his friend Nino, who lived downstairs from him at 116 Thornaby[38] Road, had put a curse on him.
He said that he heard Nino’s voice, and that of Nino’s fiance Francesca Di Dio, telling him to kill them.
In the early hours of December 21, after buying a sledgehammer, Cardinale went into Nino’s room, where he was sleeping with Francesca Di Dio. He bludgeoned Nino over the head with the sledgehammer, rendering him unconscious. Francesca “fled upstairs, literally running for her life,” the prosecutor said, “the defendant can be seen on CCTV chasing Francesca upstairs.
He was wearing a balaclava and carrying a knife.
Francesca Di Dio and Antonino ‘Nino’ Calabro
“He got his sledgehammer and held Francesca at the top of the stairs. He was then seen to drag her down to the basement. He collected the sledgehammer, before returning to the basement.”
Cardinale pleaded guilty to manslaughter, on the grounds of diminished responsibility. Judge Paul Watson KC said that he had “carefully read” reports from three psychiatrists – all of whom found that Cardinale was suffering from acute psychosis when he carried out the killings. The reports recommended that Cardinale be kept in a secure hospital, where he can be treated, rather than prison.
The judge told Cardinale: “For some time prior to the killing, you had clearly been suffering from paranoid schizophrenia – which represented itself in an acute and graphic way in the early hours of that day. It was truly awful. Unimaginable and the consequences to the families of Antonino and Francesca have been utterly devastating.
“I’m acutely conscious that nothing I say, or action which I take today, can soften or lessen the intense and acute pain of loss, which they must feel and will stay with them for the rest of their lives. “The sentence, therefore, is a hospital order with a restriction order[39]. Those orders will be without limitation of time.
It will have to be a matter for clinical management as to when, if ever, your condition has been sufficiently managed to enable you to return to the community. “I make it clear that what is envisaged is your treatment in hospital, in secure conditions, for a very long time.”
November
Drugged-up thug Christopher Kemp carried out a horrific stab attack on his then partner in her own home before killing her dog[40]. The defendant subjected the woman to a prolonged attack after she told him she wanted to end their relationship. Teesside Crown Court[41] heard Kemp grabbed, stabbed and threw the woman all while shouting “I’m going to murder you”.
Christopher Kemp
He then turned his attentions towards her dog and threw it into another room causing it a fatal injury.
Outlining the case, prosecutor Peter Sabiston said Kemp and the woman began dating in November 2022 and during their time together police were called to multiple “domestic incidents”. He said on June 30, 2023, the pair visited Ruby Garden Chinese Takeaway, in Middlesbrough[42] and while making their way home the defendant started to make “derogatory comments” about the victim under his breathe. Mr Sabiston said the Stockton[43] defendant called her a “s**g” and in response she said she wanted to end the relationship and told him to move out.
In response to this, the defendant launched the horrific attack. Mr Sabiston said: “On arrival at the victim’s address the defendant opened the door grabbed her and threw her to the corner of the room where he began to stamp on her face while shouting ‘I’m going to murder you, you’re not going to break my heart, it’s the last thing you’re going to do and you’re not getting out of this house’. She thought she was going to be killed.
The court heard he then went to the kitchen and came back with a 19-centimetre knife. He stabbed her “over and over again”. Mr Sabiston said when she attempted to stand she was thrown back to the floor and tried to protect one of her dogs.
He said: “The defendant grabbed the dog by the scruff of the neck and threw it into another room. The dog sadly suffered a fatal injury as a consequence of the attack.” The 43-year-old later pleaded guilty to wounding with intent.
His barrister Robert Mochrie asked for credit for the guilty plea and said Kemp, of Hartington Road, had a “troubled childhood” and was the subject of violence as a youngster. Mr Mochrie said the defendant began taking drugs at an early age, before substituting drugs for alcohol and then alcohol for prescription medication. Mr Mochrie said Kemp was under the influence of medication on the day of the incident and has no memory of what happened.
Kemp was handed a seven-year extended prison sentence and banned from contacting the victim for life.
December
An asylum seeker dragged a vulnerable woman off the street before raping her in a terrifying attack. Ismael Ishaq targeted the lone woman in Middlesbrough[44] in 2022 after she’d been on a night out with friends. Teesside Crown Court[45] heard the woman was targeted by another man shortly before the attack who had tried to grab her. Prosecutor Paul Cleasby said two members of the public intervened and helped the woman but shortly after the man returned and Ishaq came on the scene forcing the man to leave.
Summarising the case, Judge Peter Armstrong said: “You were far from being a knight in shining armour.
Ismael Ishaq
“You took hold of her by the wrist and dragged her to your home. You pushed her inside and raped her.” The court heard Ishaq, who came to Teesside to flee the war in Sudan, was under the influence of alcohol at the time of the attack.
Shortly after, his brave victim managed to get away and call the police. The Middlesbrough defendant was later arrested after being identified on CCTV. Mr Cleasby said Ishaq denied the rape but was convicted by a jury earlier this week.
In a victim impact statement the woman said: “I’ve had a piece of me taken away that I won’t get back, I’ve changed as a person. What happened will live with me forever.” Sentencing, Judge Armstrong said: “I take the view the psychological harm in this case was severe and the victim was particularly vulnerable due to her personal circumstances.
Women walking on their own at any time need to feel they can do so without fear of attack by predators who may be lurking.” The court heard Ishaq, of Harewood Street, is of previous good character but Judge Armstrong stressed little could be said in mitigation. The 26-year-old was handed a nine-year prison sentence.
