Drink-driver staggering in road after crash was three times legal limit
A drink-driver was found staggering around in the road after he crashed his work van[1]. Toby Wilkinson has since lost his job following the late night incident. Wilkinson had been using the Ford Transit to drive home from a friend's house after a night of drinking when the van mounted the verge on the side of the A606 in Melton[2].
Police were called to the scene of the crash shortly after midnight on Saturday, April 19, and found 30-year-old Wilkinson staggering around in the road. The breath test reading he gave was 112 microgrammes of alcohol per 100ml of breath - more than three times the limit of 35 microgrammes. At Leicester Magistrates' Court[4] last Wednesday (May 7), prosecutor Tracy Lovejoy said: "Police officers were called to a road traffic collision.
The defendant was staggering across the road to them and admitted he had been driving and he had had some alcohol." Alan Mee, representing Wilkinson, of Holland Road, Stamford, said his client, who pleaded guilty to drink-driving[5], had been fired from his job after the drunken crash damaged the work van. He said: "He had gone to visit a friend and then drove away.
That's it. "He can't explain why he's committed the offence. He hasn't got a habit of binge drinking.
It was a company vehicle. He was employed but he's lost his job. He's living with his parents and can't find work.
He's going to sign on." Wilkinson was given a community order[6] rather than a fine due to the high alcohol reading. He will have to do 80 hours of unpaid work as part of the 12-month order.
He was also ordered to pay GBP85 court costs and a GBP114 victim surcharge[7] and he has been banned from driving for 25 months.
